THE HEALTH - PRECAUTIONARY PRINCIPLE
European directive transposed into the French Law on the Energy Transition.
This law, in its First title specifies the objective:
- define the common objectives to make a success of the energy transition,
- strengthen the independence "energetics and the economic competitiveness of France
- protect the human health
- the environment fight against the global warming
The conservation of the human health is resumed in the article L. 100-1 of the code of the energy in its paragraph 4.

Yet it turns out that the meter LINKY is a real poison for the body. The CRIIREM recommends to remain in at least 2 m of the meter. Furthermore, if the meter did not emit(utter) itself, as says it the director of EDF of the electromagnetic waves no stronger than a toaster - knowing that we do not live with its toaster in service perm in the house, 24 hours a day - it is the CPL which it sends to the lines which is THE real danger. The radio frequency CPL of Linky is officially classified " potentially carcinogenic " (category 2B) for 4 years by the international Center of cancer research ( CIRC), which depends on the WHO (OMS in French).

In this case, the slightest of things is to apply the precautionary principle.
Leaned in the French Constitution, it is placed at the top of the hierarchy of the standards and thus stands out, that it exists or not legal or statutory measures.
Definition: " when the realization of a damage, although uncertain as is scientific knowledge, could affect in a grave and irreversible way the environment, the public authorities watch, by application of the precautionary principle and in their domains of attributions, the implementation of procedures of risk assessment and the adoption of temporary measures and proportionned to counter in the realization of the damage. "
The community judge dedicated this principle as " general principle of the right(law) " by two judgements delivered on May 5th, 1998 in business(affairs) relative to the bovine spongiform encephalopathy.
He asserts that " he must be admitted that, when uncertainties remain as for the existence or within the reach of the risks for the health of the people, when institutions can take protective measures without having to wait that the reality and the gravity of these risks are completely demonstrated ".
Since then, this principle covers in community law a scope wider than that of the environment, in particular the domain of the products of health or the food safety. Besides, by two judgements delivered on September 11th, 2002, the community judge brought important precision.

He calls back that the measure cannot be based on simple scientifically unchecked hypotheses, but has to base itself on a potential risk having certain degree of probability and that it is impossible to place the risk at the level " zero risk ".
Up to there, only heat emanating from electromagnetic devices was studied, in particular that of the mobile phone.
Studies are made on the electromagnetic broadcasts(emissions,issues) of the CPL, in particular by the European University Telecom of Brittany (Doctoral thesis Amilcar Mescco), quoted higher.

This signal can interfere thus with other existing services(departments), in particular the broadcasting with short waves.
It is only in 2016, that the Test Laboratory proceeded, at the request of EDF, to measures of radiative fields of Linky. Either during the deployment of the meter!
If ANSES validated Linky, it also validated OGM, vaccines with aluminum, mineral oil in the food, the chickens in the chlorine and in the dioxin..
She however recommended " to reduce the exposures "!
What about the increase of the hypersensitivity, proportional in that of the deployment of Linky? How does EDF plan to manage this problem? Is it normal that people have to run away from their accommodation, not being able to anymore live there, a few days after the installation of Linky?
Because the studies are made with devices and not on the human body, consisted in 75 % of water, and understanding(including) a surface of skin more important than a surface of an antenna(office) of device. Without counting the interaction of the waves with the natural static electricity of the body.
Attention also on the metallic tooth fillings, on the cardiac piles and on the hearing aids. Not still of return on these points, this day (in January, 2017).

Santa Cruz's county, in California, eventually decreed at the end of January (on 2012?) a moratorium on the setting-up of these meters. This decision leans on a report commanded in December, 2011 the doctor Poki Stewart Namkung, the officer of the public health of the county. The RF exposure would be cumulative, in particular because of the growing bombardment in which one every person in urban zones is from now on the involuntary victim.
The report raises, among others recognized biological effects of the radio frequencies, " a greater permeability of the hémato-encephalic barrier of the brain (Eberhardt, on 2008), negative effects on the quality of the sperm, the hurts of the double scale of the DNA which can start a cancer (Phillips, on 2011), the activation of the gene of stress as if it reacted to a toxin (Blank, on 2011), as well as a change of the metabolism of the glucose in the brain (Volkow, on 2011) ". So many serious potential effects which drove Dr Namkung to recommend the application of the precautionary principle.
